1. What BrokerPay does
BrokerPay is a brokerage payment workflow platform for real estate teams. It helps brokerages route, review, document, and track internal payment requests such as commission splits, referral fees, reimbursements, and earnest money activity.
2. Brokerage-controlled workflow
BrokerPay is designed so that brokerage administrators review and approve payment activity before funds move. Use of the service does not replace your brokerage's compliance policies, escrow rules, accounting controls, or legal obligations.
3. Accounts and access
You are responsible for maintaining the confidentiality of your login credentials and for restricting access to authorized personnel only. You agree to provide accurate account information and to notify BrokerPay if you believe your account has been compromised.
4. Payments and billing
BrokerPay may charge a recurring software subscription fee to the brokerage or subscribing customer. Payment processing for operational transfers is facilitated through third-party providers, including Stripe ACH where configured. Brokerage approval is required before supported transfers are released through the platform workflow.
5. Funds movement
BrokerPay is a workflow and recordkeeping layer. Actual funds movement depends on the brokerage's connected payment configuration, bank availability, and third-party processor status. Transfer timing can vary based on bank holidays, reviews, reversals, or disputes.
6. Acceptable use
You may not use BrokerPay to submit fraudulent payment requests, misrepresent transaction details, bypass brokerage controls, or attempt unauthorized access to accounts, data, or systems.
7. Records and auditability
BrokerPay maintains system activity records to support brokerage review, troubleshooting, and audit readiness. Those records may include payment metadata, status changes, administrator notes, and timestamps tied to your account activity.
8. Cancellations
Subscriptions may be canceled according to the plan or agreement in effect at the time of purchase. Canceling the software subscription does not automatically reverse previously submitted or approved transfer activity already in process.
9. Disclaimers and limits
BrokerPay is provided on an as-available basis. We do not guarantee uninterrupted service, processor uptime, or settlement speed. To the extent permitted by law, BrokerPay is not liable for indirect, incidental, or consequential losses arising from use of the platform.
